Some cities and towns in the USA seem to think saggin' your pants is criminal exposure. The police can actually arrest a youth for showing underwear or worse yet showing butt crack. Some cities have adopted laws that can include hefty fines and / or jail time up to a year.

We see them every day waddling down the streets in their awkward gait with one hand pulling the pants up while trying not to trip over themselves.

The saggin' fad seems to come in 4 flavors.

  1. The High Sag which shows most of the waist band of the underwear.
  2. The Medium Sag which exposes half of your butt / underwear.
  3. The Low Sag which exposes the whole butt / underwear area.
  4. The Medium sag without underwear that exposes the upper half of your nude butt.

Some people argue if they are not exposing themselves what is the problem? They start taking away our rights to wear our clothes the way we chose (not exposure of course) then what is next? It is just another infringement upon our civil liberties and they should spend their time on more important things then a few boys saggin' their pants.

Others argue that saggin' violates decency laws. Its a form of indecent exposure! Nobody wants to see someones underwear or rear-end, it needs to be banned everywhere!

Benjamin Chavis of the NAACP stated:
“The focus should be on cleaning up the social conditions that the sagging pants comes out of,” he said. “That they wear their pants the way they do is a statement of the reality that they’re struggling with on a day-to-day basis.”

Currently cities in New York, Georgia, Michigan, Louisiana and Alabama have passed laws that make sagging your pants a crime.

  • So how far or low is too far or too low?
  • Should city and state lawmakers be in the fashion business and mandate acceptable dress codes or is that crossing the line?
  • Is this a constitutional issue?

Some argue this is a constitutional issue and is freedom of expression. I think it is tacky but don't believe it should be illegal. Where do we as adults draw the line? How much of your kids butt hanging out is acceptable? These are difficult questions.

I think it's an ugly fashion statement but I don't think it should be against the law. Now what should be against the law is the low cut shirts that these girls ware, or the short tight skirts, or the low rise jeans that expose the butt crack that girls and gay dudes ware, or how about the gothik look? If your going to overhaul the dress code don't just single out sagging, both black and white and every other colors sag but it's a normal way of dressing for us (blks) when law makers single out sagging but over look booty shorts and mini skirts and skinny jeans and low rise jeans that are extreamly popular with white people it does seem unfair. I am not turning this into a racial issue but I am explaining why us black people get so pissed off about it.

I agree. I've seen worse, and no doubt someone will come up with something different to get more attention when this goes away. Whats worse ? A 50+ yr.old man in a speedo, or a 50+women in a bikini that both could loose 100 pounds.

While I completely agree with you that sagging should NOT be the singled out fashion faux pas, you have to agree that one butt crack can be just as nasty as another...

YES, I'm fully aware that sagging usually shows boxers only, but I've seen the crack slip out too.

I am a young person (relatively speaking) that doesn't agree with the sagging, skinny jeans (especially on guys... GROSS), whale tail, ultra low rise jeans, 'hot pants', super mini skirts.... I think the 80's showed less skin. Unless you were 'Madonna'.

    With the exception of the no-underwear sag as shown in the bottom photo I think this is personal expression and protected by the Constitution. In the case of no underwear - I think it violates most local decency statutes. While I'm all for freedom I think nudity crosses the line, and this is nudity in my opinion.

    As for whether children should or should not "sag" that is between them and their parents. I would be ok with a high sag with boxers. Because briefs are skin tight I would not let them wear any sag with briefs. If they want to sag more than that they'll have to wait until they're not living under my roof. I don't want my husband to "sag" either, but again, like I said, it's a personal family decision, NOT the government's (unless it crosses the line into nudity).

    Yeah, I went to a college party where many of the guys did the sock thing. I didn't stay long. It was just too unappitizing trying to drink and getting 'doinked' every where I turned. The girls all had a blast though. Most of the guys that were dressed ended up at the bar with me before too long. LOL

    My son has a midway sag; I just buy (at his request) shirts long enough to cover it up. Easy fix for both of us. . .he gets to sag and I don't have to see it.

    That's how it is with my son too. I don't really like that he sags but as long as his rear is covered I'm not going to tell him how to dress.

          Experienced this issue as a teen in the seventies. We refused to wear a bra and conventional society expressed horror and disdain (Men - - at least in front of their wives). Do people find excessive cleavage and bralessness as violating decency laws?

                I mean let's look at it rationaly. "Sagging" comes out of the prison culture, the "social conditions" they are "struggling" with is getting "street cred".

                So instead of looking at doing something about those who glorify the "criminal/thug" mindset, he wishes to try and turn this into some sort of "social" issue?

                I don't know how much of a social issue it is or how much it reflects on a family structure. Some kids do it just to be part of the crowd, others probably for street credit. I can't think of a good reason to do this in prison unless your are advertising a vacancy.

                Sagging in the prison system (where it all began) is/was in fact showing that you are/were not 'taken' yet and are/were willing to be 'taken'. i.e. ADVERTISING. After my stepbro went to county lockup for 90days, he no longer sagged his drawers. He didn't want to advertise...

                  He heads an organization that actually saw the "dress code" that the NBA brought in to make their million dollar athletes look and act like million dollar athletes as some sort of "cultural attack" against black males.

                  C'mon, people are disrobing in airports to get through security easier. How low is too low? How short is too short. This is the same battle that was fought over miniskirts years ago, and miniskirts won. It is not an issue for the law, but an issue of good taste. As trends go, people follow. Everyone should be allowed to dress as they choose. It is a "free speech" first amendment right. Even though I may see attire that I don't believe is appropriate, or perhaps even offensive, the issue not what the other person is wearing, but is my perception of it. Believe me, when someone dresses in an outlandish manner, others will let them know about it. They may dressing that way for the attention, so why give it to them. Most cities already enforce indecent exposure laws, so if someone is not breaking those laws, why should they create new laws? Obviously, most people are not exposing themselves any more than they would at the beach, and if they are, they are probably already breaking the law. Saggin' is just weird and if I had kids that wanted to sag, I would discourage them from dressing that way, but if their friends dressed that way, I would not interfere. Everyone needs to find their own identity. There is one statement by this author, with which I would have to take issue, but it's not restricted to saggin': "Nobody wants to see someones underwear or rear-end, it needs to be banned everywhere!" It all depends on the rear end and the underwear.

                  this is just a BAD look for a woman, especially when combined with the aforementioned skinny jean sag.

                  it takes what is naturally attractive about a woman (the curve of her hip) and de-emphasizes it, while simultaneously emphasizing, even accentuating her belly and back fat. It basically takes a normal woman's curves and turns them into "frog butt"

                  and that ain't ever good.

                  I, for one, am very happy that the "sweater over leggings" look is making a comeback. Call me a product of the 80's, but I've always thought women looked very womanly dressed like that.

                  I agree Frog Butt is a deplorable condition and probably not curable for many sufferers.

                    I am neutral on clothing. I am neither for or against clothing. Sometimes i support clothing and sometimes i don't. It really depends on the figures.

                    This is my opinion: I understand the need for the youngsters to have their own Identity. The problem is when a persons free spirit needs guidance then its up to the parents to guide them in the right direction. This new trend obviously comes from the need for attention. When the trend becomes offensive to others (as it does me) and the insistence of the lack of respect for other people then I believe law should be put in place to correct the lack of parental guidance. If the parents should object put them in jail or fine them. If the person is over the age then fine or jail them. MY generation had long hair and I did get paddled at school for not respecting the rules. I decided I would rather have respect than my butt busted.

                    Really? You're willing to send someone in jail for wearing baggy jeans? It sounds like that school you attended meted out some harsh punishment to enforce their stupid rules. That's messed up. The same kind of policies taught me that it's better to fight unjust rules than to bend over and take it in the butt.

                    I've seen many tattoos that were of images I found offensive; should tattoos be outlawed?

                    I've seen guys with nipple rings; is that offensive enough to outlaw?

                    I've seen girls with their bras showing above skimpy tank tops; should that be illegal?

                    I've seen plus-size women in leggings (and not with a long shirt to cover the offense), bald guys with comb-overs, and people in their pj's at the grocery store. All are somewhat offensive to me. Should those things be outlawed?

                    Really? What is the law that's being broken? Being offensive is not (in most cases) illegal. Being obscene, on the other hand, is illegal. Just because you're personally offended by someone or something, that doesn't make it illegal.

                    Sagging is stupid and tacky, but if that's what people want to be, so be it, so long as they don't actually expose themselves. We just need to continue to show how effing retarded it is, it's actually becoming less prevalent in my area, at least anything other than the "high sag", which doesn't really offend me since its usually covered by the shirt. The no-underwear sagging picture was just wrong.

                    I voted no on #1, but some of the sagging borderlines on complete public nudity if it were not for the boxers. #2 Any age is to young to wear pants sagging to the point were you have to hold them up with your hand or let your underwear and butcrack show. #3-Absoloutly not to any degree. #4-I believe it is a right but again borderlines on infringing on the rights of others in public by exposing the underwear which most of the time is stuck between the cracks. Disgusting. But most guys I notice seem to prefer their pants hanging a little low, not sagging. Two different things. Its a guy thing to wear their wasteband a little low.

                    As for Chavis of the NAACP stating its social conditions, and the day to day struggle these poor sagging kids have to deal with that cause them to wear their pantswaist off the bottom of their ass is a crock of BS. This is the mentality so called leaders project out and its a pathetic excuse for saggypants wearers and the leaders. They have a choice to make their life a successfull one. But its much easier to be a saggypants wearer or perhaps a gang member and blame it on society than it is to get off their butts, get an education, and a job.

                    Never liked the sag. Ass smells, point blank. I don't want it in my face, I hate seeing guys waddle like penguins because they can't walk right. All do to their pants below their ass. It is not unconstitutional however and is a personal choice. It shouldn't be made illegal. But what is wrong with keeping your pants on your ass? And what is the point of wearing a belt if you don't use it to keep your pants on your waist? I wish this style would be over and done with.

                    In time men will grow up . and So should your pants and the way you dress. Im a firm believer of the way you dress is a reflection of how you feel and who you are. If you want to walk around with your pants half-ass, to me that says you are a half-ass individual that will never tackle life with the full force needed to succeed.

                    A professional skateboarder may not really be the best example; I mean, he obviously cannot wear his pants too low since it would be hard to skateboard while doing so.

                    I have to agree that a guy who wears his pants with his rear sticking out is saying a lot more about himself -- a lot more negative and positive.

                    Actually, he is a very good example because he does sag. Not to the point where you see something, but he is still a sagger. I used him as an example because he's my son's favorite skater. Also, my son sags and he's a skater too. The trend for saggers now a days is not belts to help hold pants in place, it's shoe strings.

Now, I to like Rob D. he is an awesome skater, but the only difference he is actually doing something positive and he is succesful. But count how many "grown men" you will see today in the street with their pants saggin that are actually doing something positve.

                      A local municipality passed a law about sagging pants a little while back. If caught with sagging pants that expose any part of your underwear, the person can be fined. I think it is all just silly. As long as they are wearing underwear under the pants, I don't see where it is anybody's business to tell them how to wear their pants(while at work or school would be the exceptions as there are dress codes in place...also parents should have the right to enforce their own dress code on their kids). You want to show off your spiffy new boxers for all the world to see? I don't care. If you feel comfortable walking around holding your pants up with one hand all day...good on ya. It isn't a look I personally care for, but to each their own. I don't let my kids sag much beyond the waistband of their boxers and some of that is just when I buy them the next size up to give room for growth and they are a bit big on them. I don't think that the trend/fashion statement needs to be legislated in any way. Seems like a waste of gov't time.

                        I have to admit that when I see young men dressed this way, I tend to stereotype them (right or wrong).

                        While I'm all for the freedom of expression, parents should be raising their children to understand that if they want to succeed in life, they need to come across as someone who can be taken seriously. If two candidate were to walk into my office for an interview, one wearing a suit (or at least a tucked in shirt and khakis), and the other in baggy pants and a sideways ball cap, even if their qualifications were the same, guess which one would probably get the job?

                        1. Personally, I don't want to see your underpants - period. So if I can see your underpants, something ain't right.

There shouldn't be any laws about acceptable clothing - it makes it so much easier to identify people I don't want to associate with, don't want to know, and definitely don't want to hire. Let them "express" themselves that way so I don't have to waste my time talking to them to discover they're a moron.

                        3. It has nothing to do with the constitution. Morons are allowed to be morons in moronic ways.

                        I think about my 4 yr old grandson.

                        He came out from getting dressed one day pulling his jeans down to the "sag position", to as he said "look cool".

                        I told him no one wants to see your underwear...................and started laughing that he didn't know how to dress himself.

                        Now he keeps bugging his mother to buy him a belt so that he'll look like a big guy is supposed to.
